These Terms of Service govern your access to and use of Gephra KAYE.

Gephra KAYE is operated by Gephra Ltd, a private technology company registered in the Republic of Rwanda.

By creating an account, clicking to accept, or using Gephra KAYE, you agree to these Terms together with the Privacy Policy.

In these Terms, "Services" means the Gephra KAYE mobile application, related software, support services, billing features, and connected digital services made available by Gephra Ltd.

Customer Data means records relating to a business user's customers, including contact details, measurements, job history, and payment history. Platform Billing means subscription fees or other charges payable to Gephra for use of the Services.

You may use Gephra KAYE only if you can lawfully enter into a binding agreement, provide accurate registration information, and use the service in accordance with applicable law.

If you use Gephra KAYE on behalf of a business, you represent that you have authority to bind that business to these Terms.

You are responsible for keeping your account information, passcodes, devices, and verification methods secure.

You must notify Gephra promptly if you suspect unauthorized access, fraud, or account compromise.

Gephra KAYE helps businesses manage customer records, body measurements, job cards, payment tracking, notifications, reporting, and related business operations.

Unless expressly stated otherwise in writing, Gephra KAYE does not provide legal, tax, lending, or credit-scoring services.

If you use Gephra KAYE for business operations, you are responsible for the data you enter and the way you use the service in your business.

Some parts of Gephra KAYE may require a paid subscription or another billing arrangement.

Gephra KAYE distinguishes between customer job payments recorded by business users and platform billing owed to Gephra Ltd.

Applicable pricing, billing frequency, trial details, and plan limits are presented in the app, on plan pages, or in a separate commercial agreement.

If you enroll in a paid plan, you agree to pay the fees applicable to your chosen plan and authorize the payment method or payment flow presented for that purpose.

If subscriptions renew automatically, that renewal behavior must be disclosed in the relevant billing flow or plan terms.

If fees are not paid when due, Gephra may restrict paid features, place the account into a grace or limited-access state, or suspend access after reasonable notice where appropriate.

You may cancel your subscription to Gephra KAYE at any time through the application settings or by emailing billing@gephra.com.

Cancellation prevents future billing cycles but does not trigger a refund for the current period.

All fees paid are non-refundable, and Gephra does not provide credits for partial months or unused service time.

You may not use Gephra KAYE for unlawful purposes, to misuse data, to commit fraud, to impersonate another person, to interfere with service security, or to upload malicious code.

Gephra KAYE may rely on third-party services such as app stores, messaging providers, payment providers, cloud infrastructure providers, WhatsApp, analytics tools, and support tools.

Use of those services may also be subject to their own terms and privacy practices.

Gephra and its licensors own all rights, title, and interest in Gephra KAYE, including the software, branding, documentation, and related intellectual property rights.

Subject to these Terms, Gephra grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your lawful business or personal use.

You retain ownership of records and content you lawfully submit, but you grant Gephra the rights reasonably necessary to host, process, transmit, back up, secure, and display that content to operate and improve the Services and comply with law.

Your use of the service is also governed by the Gephra KAYE Privacy Policy.

You must keep customer data confidential and use it only for legitimate business purposes.

Reports generated in Gephra KAYE are summaries of records entered or maintained in the service.

They are not credit scores, lending advice, or credit guarantees by Gephra Ltd.

Gephra may suspend or terminate access where you breach these Terms, fail to pay required fees, create security or legal risk, or where continued service is not reasonably possible.

Upon expiration or cancellation of a paid subscription, Gephra provides a thirty (30) day grace period during which you may access the service only to export customer records and measurement history.

After that period, Gephra may permanently delete records associated with your workspace, subject to applicable law and the data retention policy.

Gephra may update, improve, modify, suspend, or discontinue parts of the Services from time to time.

Gephra aims to operate the Services reliably but does not guarantee uninterrupted or error-free availability. Planned maintenance, outages, third-party failures, connectivity problems, and security events may affect access.

To the maximum extent permitted by applicable law, and except where Gephra expressly agrees otherwise in writing, the Services are provided on an "as is" and "as available" basis.

Gephra does not guarantee uninterrupted availability, error-free operation, or that use of the Services will guarantee business growth, financing, or specific outcomes.

To the maximum extent permitted by Rwanda law and general commercial law, the total aggregate liability of Gephra Ltd for any claim arising out of or relating to these Terms or the service will not exceed the total fees paid by you to Gephra Ltd in the twelve (12) months immediately preceding the event giving rise to the claim.

Gephra Ltd shall not be liable for indirect loss of profits or business opportunities.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or breach of obligations that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold Gephra harmless from third-party claims, losses, damages, or expenses arising from your breach of these Terms, your unlawful use of the Services, your unlawful handling of customer data, or your violation of another person's rights.

These Terms are governed by the laws of the Republic of Rwanda unless another mandatory law applies and cannot lawfully be excluded.

Before formal legal proceedings are started, users are expected to contact Gephra in good faith so the issue can first be addressed amicably.

Gephra may update these Terms from time to time and may notify users through the app, by email, through account notices, or by other reasonable means when material changes are made.

Gephra may provide notices, disclosures, and contractual information electronically, including through the app, SMS, email, or other digital means used in connection with the Services.
